General Terms and Conditions for Digital Products
1. Scope
These General Terms and Conditions (Terms) apply to all contracts for digital self-study courses, learning materials and other digital products offered and sold by Vahagn Arakelyan in his own name or under the name Readanduseit.
They are intended for consumers within the meaning of section 13 of the German Civil Code (BGB).
2. Provider
Vahagn Arakelyan, also trading under the name Readanduseit, Urbanstraße 16, 73207 Plochingen, Germany. Email: vahag12102004@gmail.com.
3. Products and scope of supply
Each contract concerns the digital product or self-study offer specifically described to the customer before purchase. Depending on the offer, it may include recorded video lessons, digital learning materials and PDF files, exercises, tasks and solutions for self-checking, other digital content, and any bonus materials expressly named in the offer. The exact scope is determined exclusively by the description of the relevant offer provided before purchase.
Where an offer is a self-study course, it is intended for independent learning. Individual correction or assessment of tasks, monitoring of learning progress, individual subject-matter advice or personal learning support forms part of the contract only if expressly stated in the relevant offer. Separately offered services such as individual tuition, conversation courses or other personal services are not part of a digital product unless the offer expressly states otherwise.
Specific B1.1 offer: this is a self-study course containing recorded video lessons and PDF exercises with solutions for self-checking. It is purchased with a one-time payment, includes technical assistance and provides access without a specified end date. Individual learning support, marking, assessment, progress monitoring, teacher-led lessons and conversation clubs are not included in the B1.1 offer.
4. Order and conclusion of contract
Before payment, the customer receives the essential information about the relevant product, total price and method of supply, together with access to the applicable Terms, withdrawal information, model withdrawal form, legal notice and privacy policy.
For digital content, the purchase continues only if the customer expressly agrees that Vahagn Arakelyan may begin supplying the digital content before the statutory withdrawal period expires and confirms awareness that, subject to the statutory conditions, the right of withdrawal expires when performance begins. If the customer does not give this consent and confirmation, the purchase does not continue and no contract is concluded.
After giving consent, the customer receives a Stripe payment link. The contract is concluded when payment is completed successfully. After conclusion, the customer receives confirmation of the contract on a durable medium at the email address supplied during payment.
5. Price and payment
The total price communicated before payment applies. Promotional prices and discounts apply only under the conditions stated in the relevant offer. Later price changes do not affect contracts already concluded.
A digital product is generally acquired by a one-time payment unless the specific offer expressly states otherwise. Automatic renewal or a subscription exists only if expressly agreed before purchase. The B1.1 offer is purchased with a one-time payment and has no subscription or automatic renewal.
Payment is processed through Stripe. After successful payment, the customer receives a payment confirmation. Statutory obligations to issue invoices remain unaffected.
6. Supply and access
Digital content is supplied in the form described in the relevant offer, particularly through a private Telegram channel, download link, email or a comparable digital access method. After successful payment and transmission of the contract confirmation to the stated email address, the customer receives the agreed access.
Where an offer promises access for an unlimited period, access is granted without a specified end date. Any different access periods follow from the relevant offer description. Access to B1.1 is provided without a specified end date.
Depending on the offer, use may require a Telegram account, internet access and a suitable device. The customer may contact Vahagn Arakelyan by email regarding technical supply problems. Statutory rights relating to supply problems or defects in the digital product remain unaffected.
7. Right of withdrawal
Consumers generally have a 14-day right of withdrawal. Details are set out in the separate withdrawal information below on this page.
For paid digital content not supplied on a tangible medium, the right of withdrawal expires early only if the customer expressly agrees to performance beginning before the withdrawal period expires, confirms awareness that the right is lost when performance begins, receives the corresponding contract confirmation pursuant to section 312f BGB, and supply of the digital content has begun. The required consent and confirmation are expressly requested before payment. Statutory rights relating to defects remain unaffected.
8. Technical assistance
Vahagn Arakelyan assists customers with technical and organisational issues relating to payment, delivery of contract documents, and access to or retrieval of the supplied digital content. Enquiries may be sent to vahag12102004@gmail.com.
Individual learning support, answers to subject-matter questions, correction of tasks, assessment of knowledge or monitoring of personal learning progress forms part of the support only when expressly promised in the relevant offer. B1.1 includes technical and organisational assistance only; learning support is not part of that offer.
9. Personal use and sharing
Purchased digital content is intended for the buyer's personal use. Unauthorised sharing of personal access and unauthorised reproduction, public publication, redistribution or resale of digital content are prohibited. Uses permitted by law and statutory limitations of copyright remain unaffected.
10. Statutory rights relating to defects
The statutory provisions governing digital products apply to the supplied digital content. These Terms do not restrict the customer's statutory rights in the event of non-supply, defective supply or supply that does not conform to the contract. Expiry of the right of withdrawal under clause 7 does not affect these statutory rights.
11. Final provisions
German law applies. If the consumer habitually resides in another country, mandatory consumer-protection provisions of that country remain unaffected where applicable under the law.
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions and the statutory rules applicable in place of the invalid provision remain unaffected.
Withdrawal information
A consumer may withdraw from the contract without giving a reason within 14 days from the date the contract is concluded. To exercise the right, inform Vahagn Arakelyan, Urbanstraße 16, 73207 Plochingen, Germany, email: vahag12102004@gmail.com, of the decision by a clear statement, such as a letter or email. The model form below may be used but is not mandatory. Sending the notice before the deadline is sufficient. Statutory rules governing the start and extension of the period remain applicable.
For paid digital content not supplied on a tangible medium, the right of withdrawal expires when supply begins only if the customer previously expressly agreed to performance beginning before the 14-day period ends, confirmed awareness that the right is lost when performance begins, received the legally required contract confirmation recording those statements, and supply of the digital content began. Payment or general acceptance of terms alone does not replace these requirements. If every condition for early expiry is not satisfied, the right of withdrawal remains in place.
The separate pre-payment declaration states: “I expressly agree to the supply of the B1.1 digital course materials beginning after payment, before the 14-day withdrawal period ends. I acknowledge that I understand that I lose my right to withdraw without giving a reason (Widerrufsrecht) when supply begins. My statutory rights in relation to defects remain unaffected.”
Following a valid withdrawal, all payments received under the contract are reimbursed without undue delay and no later than 14 days after receipt of the notice, using the same means of payment unless another method is expressly agreed. No reimbursement fee is charged. Permission to use the course ends when the contract is terminated. Statutory rights relating to defective or undelivered content remain unaffected.
